It's no great surprise, of course, that a bunch of lawyers have come up with a decision that defies all logic and natural justice, but that doesn't make the victory for Turds any more palatable. Apparently Curbishley had it written into his contract that he had the "final say on the selection of players to be transferred to and from the club". So, on his own admission, Turds was responsible for the signing of Boa-Morte, Quashie, Davenport, Dyer and Ljungberg. Now if that's not five very good reasons for sacking somebody, I don't know what is!
Then there is the little matter of our huge debt, the result of Curbishley's "little boy let loose in a sweet shop" approach to the transfer market. "If it is barely alive, buy it!" Turds is upset because we sold Ferdinand and McCartney to cover some of our mounting debts. Well. what exactly was the Board meant to do? Just open the door and wave in the bailiffs? We are crippled by debt as it is, our position would have been even worse had we not recouped £14m for two players who, based on the side selected on Saturday, are not good enough to make it into the Sunderland team! The sales made sound business sense irrespective of our financial plight. Ilunga is a better player than Linda and cost less than half what Sunderland paid us for McCartney! Curbishley's gripes just prove that he lacks judgement and should not be allowed to have the final say on transfers.
According to Richard Bevan, chief executive of the League Managers' Association, Curbishley has "played such a prominent part" for West Ham "both as a player and manager"! Bollocks! Curbishley walked out on West Ham as a player when we were relegated and walked out again as a manager. Curbishley claims, "I had no alternative but to resign" but that is nonsense, the alternative was to stay and get on with the job.
The truth of the matter is that the players, led by Neill, revolted against Curbishley and his inept tactics. His position was "made untenable" when the players decided that the emperor had no clothes; the sale of McCartney was the excuse, not the reason why Turds left.
Harold Shipman must be turning in his grave. Based on this decision, if alive he could have claimed wrongful dismissal after he was sacked as a GP for murdering his patients! "It was in my contract that I had the final say on transfers in and out of the world!"

cant win matches, cant win court cases....
as an outsider it seemed pretty clear cut to me, he didn't want players sold they were sold behind his back and that was a breach of his contract, blame the ownership of the club

I remember when Curbishley's name was being banded about when Eggy was going through the selection process of finding our new manager. You had the likes of Tony Cottee on skysports news giving it the 'he's West Ham through and through' and all the simpletons on the blogs doing the same as Deane has rightly touched upon. I wrote to Eggy then, telling him it would be a big mistake to hire Curbishley and I still have a copy of that letter. I sent it to teh club and the training ground just to make sure it was passed on. I was disgusted when he hired Curbishely. We had to get out of this ex-West Ham, local boy mentality if we needed a world class manager.
Let's now see if Mr West Ham through and through turns around and says that he's happy with the verdict but will not accept any money as he doesn't wanna harm his own club.
We should sue him for those signings you mentioned HF and for the contracts he gave them. I can't even look at the bloke now. He disgusts me.

You may have an axe to grind with Curbishley for his actions over walking out but this post makes me wonder what you know about Employment Law...
Constructive Dismissal does not defy "all logic and natural justice" but very clearly points that if you can prove you are being prevented from doing your job in order to make you leave (so the firm can avoid a payout) you can still be awarded.
I would have thought you would have seized upon this to go after you 'Dark Puppet Master'.

You would have thought he would have remembered the small detail of consulting Curbs on transfers before cutting him out of the loop in the July.
I'm not going to argue the Pros and Cons of Curbs here, but surely this would be the perfect time to argue that Duxbury has yet again cost the club millions and to admit to having tried to counter sue Curbs for time and expense incurred looking for Z&C is beyond low from a club that used to have respect for it's managers?
Fanno, I 100% lay the blame at yours and Del's feet.
If we had got behind Curbs for another season as I and a small minority had asked for, there wouldn't have been a snowballing momentum to rid the club of Curbs, and we wouldn't be in this mess.
Never wanted him pleased to see the back of him cost the club millions and 2million is a small price to get rid of him before he ruined the club completely
